Frankfurt Drafting School (FDS)

Die diesjährige Frankfurt Drafting School fand vom 18. bis zum 20. September 2023 statt. Die FMAA dankt allen Teilnehmern und Dozenten für drei spannende Tage und freut sich, Euch nächstes Jahr wieder in Frankfurt begrüßen zu dürfen!


 

Das Konzept

Vor Beginn des Willem C. Moot Court haben die teilnehmenden Teams in der Regel nur geringe Kenntnisse über das UN-Kaufrecht und die Schiedsgerichtsbarkeit. Dies führt dazu, dass sich die Teams während der kurzen Zeit der Erstellung des Klägerschriftsatzes nicht nur mit einer neuen Form der Darstellung vertraut machen, sondern sich auch neue Rechtsmaterien erarbeiten müssen. Während dies beim UN-Kaufrecht verhältnismäßig zügig möglich ist, bereitet speziell das Schiedsrecht Schwierigkeiten. 

Abhilfe in dieser Hinsicht soll die Frankfurt Drafting School (FDS) schaffen. Neben einer Einführung ins UN-Kaufrecht wird im Rahmen dieses Seminars auf die Vorgehensweise bei der Schriftsatzerstellung  und auf Hintergründe zur Schiedsgerichtsbarkeit eingegangen. Ein erfahrener Teambetreuer vermittelt den Teams Grundlegendes über die Erstellung von Kläger- und Beklagtenschriftsatz. Dies geschieht unter Zuhilfenahme alter Wettbewerbsschriftsätze, die als Positiv- bzw. Negativbeispiele analysiert werden. Praktiker liefern Hintergrundinformationen über Schiedsrecht, Schiedsvereinbarung und Schiedsspruch.

Die FDS ist ein dreitägiges Seminar, das teils in deutscher, teils in englischer Sprache abgehalten wird. 


  

The Concept

Before the Willem C. Vis Moot Court starts in early October, the freshly chosen Mooties usually have little knowledge of the CISG or the applicable arbitration laws. Moreover, most of them have never faced the challenge of writing a memorandum and making a case from a client’s perspective. Hence, in the short amount of time they are given to produce both memoranda, the participants not only have to deal with fields of law previously unknown to them, but also have to familiarise themselves with a new form of presenting legal arguments.

This is where the Frankfurt Drafting School (FDS) aims to provide valuable assistance. During the course of this three-day seminar, the participants are introduced to the basic concepts of International Commercial Arbitration and to the CISG. Lectures will be held by renowned academics and practitioners who are affiliated with the Vis Moot Court as coaches and/or arbitrators. Furthermore, in a long-standing FDS tradition, two experienced former coaches will conduct hands-on memorandum drafting exercises with the participants and analyse memoranda from past editions of the competition.

The FDS lasts three days and is conducted partly in German and partly in English.
